Phoenix-library is a service of eBooksFrance ASBL, a Belgian non-profit organization registered under N�25852/2000. Becoming a registered member of Phoenix-Library does not imply, in any form, association with Phoenix-Library. Phoenix-Library, at its own discretion, has the right at any time to change or discontinue these Terms of Use and any aspect or feature of the site, including, without limitation, the content, hours of availability, and equipment needed for access or use of the site, what parts of the site are for public access and what are not. These terms of use apply to all users with no exception. You shall use the site for lawful purposes only. You shall not post or transmit through the site any material that (i) violates or infringes in any way upon the rights of others, or (ii) encourages conduct that would constitute a criminal offense, gives rise to civil liability or otherwise violate any law. Any conduct by you that in Phoenix-Library's discretion restricts or inhibits any other user from using or enjoying the site will not be permitted..

You expressly agree that use of the site is at your sole risk. Neither Phoenix-Library, its affiliates, nor any of their contributors, agents, third party content providers, licensors or any person or entity related to this website warrant that the site will be uninterrupted or error free; nor do they make any warranty as to the results that may be obtained from use of the site, or as to the accuracy or reliability of any information, service, software or any file provided through the site.

The above disclaimer of liability applies to any damages or injury caused by any failure of performance, error, omission, inaccuracy,interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of this site, whether for breach of contract, tortious behavior (including strict liability), negligence, or under any other cause of action. You specifically acknowledge that Phoenix-Library.org is not liable for the defamatory, offensive or illegal conduct of other users or third-parties and that the risk of injury from the foregoing rests entirely with you.

4. Downloading eBooks

Accepting these terms of service, gives you the right to download any book from the public pages of the Phoenix-Library website, with the following basic restrictions:

a) If the books are public domain, you can do anything you like with these books, such as re-posting them on your site, printing them, distributing them, converting them to other formats, etc... but you must always include a reference to the original source. No commercial use is allowed.

b) Some books have copyright restrictions. You can still download and read these, but you may not be allowed to reproduce, modify or distribute them. These restrictions (if any) are NOT set by Phoenix-Library but by the copyright owner of the ebook. For further information, download the book and/or read the full notice that accompanies the book.

c) Phoenix-Library wants to keep this site free of digital piracy. But Phoenix-Library only provides storage facilities. The entire civil and criminal responsability lies entirely with the user that uploaded them in the first place. In order to help Phoenix-Library fight against copyrights infringements, voluntary or not, please report immediately any copyright or other law infrigment detected and any violation, voluntary or not, to the integrity of the author's work.

d) You cannot mirror or reproduce any part of this website without the writen permission of Phoenix-Library.

5. Uploading ebooks:

Accepting these terms of service, you have the right to upload any book to the public pages of Phoenix-Library website, respecting the following restrictions:

1. You MUST be a registered user, with a valid e-mail address and be a fully identificable person. Anonymity is not allowed in your profile, but you can use any designation you want as a public name.

2. You shall not upload, or otherwise make available on the site any material protected by copyright, trademark or other proprietary right without the express permission of the owner of the copyright, trademark or other proprietary right and the burden of determining that any material is not protected by copyright rests with you. You shall be solely liable for any damage resulting from any infringement of copyrights, proprietary rights, or any other harm resulting from such a submission.

3. You MUST have in your title clearly stated, the copyright status of the work, the digital source, the party responsible for conversion to the eBook format and the e-mail adress of the copyright owner, if any.

4. All copyright restrictions (if any) MUST be clearly stated in the resume of the uploaded title and inside the file.

5. All SAMPLERS (if any) must be clearly identified as such.

6. You accept that Phoenix-Library will remove from this site, and put on hold, any title reputed as being an infringement of copyright or any other law, or as not respecting the integrity of the author's work, regardless of the veracity or not of the accusation, until the question is solved between you and the complaining person, company or organization.

7. We will not be responsible for any loss of content you upload, whether arising from our suspension of your access or deletion of content, or any site outages, file corruption or other causes, whether or not within our control. The Phoenix-Library website is provided "AS IS" without warranty of any kind. You are uploading and accessing content entirely at your own risk, and you are solely responsible for the files you upload and for maintaining back-up copies of any content posted. WE DISCLAIM ALL INCIDENTAL, INDIRECT, CONSEQUENTIAL OR SPECIAL DAMAGES OR LOSSES arising out of or relating the use of this website. 1. No copying, redistribution, retransmission, publication or commercial exploitation of downloaded material will be permitted without the express written permission of Phoenix-Library and the copyright owner. In the event of any permitted copying, redistribution or publication of copyrighted material, no changes in or deletion of author attribution, trademark legend or copyright notice shall be made. You acknowledge that you do not acquire any ownership rights by downloading copyrighted material.

7. Monitoring.

Phoenix-Library shall have the right, but not the obligation, to monitor the content of the site to determine compliance with these Terms of Use and to satisfy any law, regulation or authorized government request. Phoenix-Library shall have the right in its sole discretion to edit, refuse to post or remove any material submitted to or posted on the site. Without limiting the foregoing, Phoenix-Library shall have the right to remove any material that Phoenix-Library in its sole discretion, finds to be in violation of the provisions hereof or otherwise objectionable.

These Terms of Use shall be construed in accordance with the laws of Belgium, without regard to its conflict of laws rules. No waiver by either party of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default.
